PUBLIC OFFER OF THE ONLINE STORE

1. General provisions and basic terms

1.2. Online store - website "PAEVSKAYA HOME DESIGN" at the Internet address: https://paevskayahomedesign.ru/. With its help, the seller conducts trade; it presents the goods that the seller offers to customers, the terms of purchase, delivery, payment, return and exchange of goods.

The website is available 24 hours a day. Store working hours (processing and fulfilling orders, etc.): from 9:00 to 18:00 Moscow time on weekdays and from 09:00 to 16:00 Moscow time on weekends.

1.3. Buyer - any individual or legal entity who has placed an order for the purchase of goods from the seller in accordance with the established section. 3 offers in order.

Buyer-consumer is an individual who purchases goods for personal, family, household and other needs that are not related to his business activities.

1.4. An offer is a public offer by the seller to any person to enter into a contract for the purchase and sale of goods on its terms (hereinafter referred to as the contract). The offer is public (clause 2 of Article 437 of the Civil Code of the Russian Federation).The offer comes into force from the moment it is posted on the online store website at the address: https://paevskayahomedesign.ru/ and is valid until its withdrawal.

The seller has the right to change or withdraw the offer unilaterally. All changes come into force and are considered brought to the attention of the buyer at the time of posting on the specified Internet page. Orders that have already been placed at the time the offer is changed or withdrawn are executed on the terms of the offer that were in force at the time of their placement.

2. Subject of the agreement

2.1. The seller undertakes to transfer ownership to the buyer, and the buyer undertakes to pay for and accept the goods ordered under the terms of the offer in the online store.

2.2. Product - any product that the seller offers for sale on the website of an online store using a catalog with the names of product positions, which are provided with its description (including price, information about the characteristics of the product, warranty periods, etc.) and photographs. The current edition of the catalog is posted on the online store website at: https://paevskayahomedesign.ru/catalog/. All goods are non-food.

3. Procedure for concluding an agreement, placing an order

3.1. Acceptance of an offer is the moment when the buyer places an order for goods from the seller. From this moment the contract is considered concluded.3.2. The buyer can place an order by calling the online store during business hours or independently on its website through the order form. An order can be placed for any product from the catalog on the online store website at: https://paevskayahomedesign.ru/catalog/, which is available at the seller’s warehouse.

3.3. When placing an order, the buyer enters data on the online store website or informs the seller of his full name (title), contact phone number and email address, delivery address of the goods, delivery methods, methods of payment for the order. The buyer selects these desired indicators taking into account the terms of the offer, as well as the territory and time intervals of delivery posted on the online store website at: https://paevskayahomedesign.ru/delivery/.

3.4. The order is considered placed at the moment:

clicking the "Place an order" button at the last stage of placing an order - when you check out on the online store website yourself. If necessary, within 4 (four) business hours from the moment the order is placed, the online store manager contacts the buyer by phone to confirm the availability of the product, provide the order number and coordinate its delivery;verbal confirmation of the order to the manager by phone of the online store - when ordering by phone. The order is considered confirmed after the manager has confirmed the availability of the ordered goods and the cost of the order, recorded all the information necessary for delivery and informed the buyer of the order number.

3.5. To confirm the order and the conclusion of the contract under the terms of the offer, the seller sends the date and number of the placed order by email or message to the phone number provided by the buyer.

3.6. By placing an order, the buyer confirms that:

is a legally capable citizen or a representative of a legal entity authorized to order goods;

I have read the current version of the offer and agree with its terms;

undertakes the obligation to pay for the ordered goods and accept it;

provided reliable information when placing an order;

I have read the Seller’s Personal Data Processing Policy, located at: https://paevskayahomedesign.ru/privacy/;if the Buyer is an individual, personal data provided when placing and executing an order may be processed by the Seller for the purpose of concluding and executing an agreement, including placing an order, payment, delivery, returning goods, maintaining accounting and tax records, processing requests and fulfilling the requirements of the legislation of the Russian Federation, on the grounds and in the manner provided for by the legislation of the Russian Federation and the Personal Data Processing Policy;

in cases where the processing of personal data requires the consent of the subject of personal data, such consent is provided separately in the manner prescribed by the document “Consent to the processing of personal data” located at: https://paevskayahomedesign.ru/privacy/.

placing an order and clicking the “Place an order” button constitutes acceptance of this Offer and does not constitute consent to receive advertising and informational messages;

preliminary consent to receive information and advertising messages is provided by the Buyer separately, by performing an independent action in the site interface provided for in the document “Consent to receive information and advertising messages” located at: https://paevskayahomedesign.ru/privacy/

The provision of such consent is not a condition for the purchase of goods, the conclusion or execution of a contract;messages necessary for registration, payment, delivery, return of goods and execution of the contract do not relate to advertising messages and can be sent in the manner established by the legislation of the Russian Federation.

4. Order cost and payment

4.1. The cost of the order consists of the price of the product and the cost of its delivery, which are determined by the seller unilaterally. If the seller changes the price of the product or the cost of delivery after placing the order, the order is paid at the cost at the time of placing the order.

4.2. The price of the product is determined according to the catalog on the online store website at: https://paevskayahomedesign.ru/catalog/.

4.3. Delivery costs are not included in the price of the product.

4.4. The buyer can pay for the order in cashless form.

4.5. When paying in cash, the buyer pays the cost of the order at the time of delivery of the goods. The seller issues the buyer a cash receipt or other document confirming payment for the goods.

4.6. With a non-cash form of payment, the buyer makes a full prepayment of the order within 72 hours from the moment it is placed. The buyer's obligation to pay for the order is considered fulfilled when the full amount of the prepayment is received into the seller's bank account. If payment is not received within the specified period, the order is considered canceled, of which the seller notifies the buyer by message.

5. Delivery of goods5.1. The seller delivers the goods within the time period agreed upon with the buyer when confirming the order by courier to the buyer’s address, delivery service point or office indicated on the online store website at: https://paevskayahomedesign.ru/delivery/. The delivery method (and pickup point for pickup) is chosen by the buyer when placing an order.

5.2. Upon receipt of the goods, the buyer is obliged to inform the courier or the manager of the pickup point with the order number and present an identification document. If the buyer is a legal entity, his representative presents a power of attorney to receive the goods and a document proving his identity.

5.3. When handing over the goods, the buyer checks its appearance and completeness and signs the order form, thereby confirming that he has received the goods and has no complaints regarding its appearance, quantity and completeness.

5.4. Ownership of the goods passes to the buyer at the time of actual transfer of the goods to him, subject to full payment.5.5. If the buyer does not show up for the goods at the pick-up point within the time agreed upon when placing the order or does not perform other actions necessary to accept the goods, the seller delivers the goods again, at a new time agreed with the buyer by telephone. For repeated delivery, the buyer will be charged according to the seller’s tariffs indicated on the online store website at: https://paevskayahomedesign.ru/delivery/.

6. Order changes and cancellations

6.1. If, after placing an order, the seller discovers that the ordered product or the required quantity is not in stock, he will immediately notify the buyer about this by phone. The buyer has the right to replace the missing product with a similar one or refuse the order completely or only in part of the missing product.

6.2. The buyer has the right to cancel the completed order in whole or in part by telephone or by e-mail at any time before its transfer. There is no payment for such an order (or part of an order).

6.3. If the buyer refuses the prepaid order in accordance with clauses 6.1, 6.2 of the offer, the seller returns the amount paid for the order (and in case of partial refusal, the overpayment amount) to the same bank details from which it was received by the seller, or to other details that the buyer will notify the seller in writing. Refunds are made within 7 (seven) business days from the date of order cancellation.6.4. By agreement with the seller, the buyer has the right to change the order no later than 24 hours before the start of the agreed delivery time interval. If the order is prepaid, the seller adjusts its cost and informs the buyer of the amount that needs to be paid in addition, or returns the overpayment to the buyer’s account in the manner provided for in clause 6.3 of the offer.

7. Return and exchange of goods

7.1. If the buyer discovers defects in the goods, he has the right to present to the seller the requirements provided for by the Civil Code of the Russian Federation and other legal acts. In particular, he has the right to refuse the contract, return the defective product to the seller and demand a refund of the money paid. The buyer-consumer also has the right to present the requirements provided for by the Law of the Russian Federation “On the Protection of Consumer Rights” dated 02/07/1992 N 2300-1, the Rules for the sale of goods under a retail purchase and sale agreement, approved by the Decree of the Government of the Russian Federation dated 12/31/2020 N 2463, and other legal acts in the field of consumer rights protection. The procedure for submitting claims is determined by the specified legal acts.7.2. Complaints regarding product quality are sent in writing to the seller’s email address. The claim must indicate the full name of the buyer, order number and date, date of payment and date of delivery of the goods, as well as describe the identified deficiencies, the date and circumstances of their discovery. Photographs may be attached to the claim.

7.3. The buyer-consumer has the right to refuse goods of proper quality at any time before its transfer, and after the transfer of the goods - within 7 (seven) days from the date of its transfer, if the presentation, consumer properties of the goods, as well as a document confirming the fact and conditions of purchase are preserved. In the absence of such a document, the Buyer has the right to refer to other evidence of purchase of the goods from the Seller.

To process a return, the Buyer sends an application to the Seller indicating the last name, first name, patronymic, order number and date, payment date and date of delivery of the goods.

The right to refuse goods of adequate quality does not apply to goods made to order or according to the Buyer’s individual parameters, having certain properties, if such goods can be used exclusively by the Buyer purchasing it, as well as in other cases directly provided for by the legislation of the Russian Federation.7.4. The buyer can return the product (both of proper quality and with defects if it is returned under the terms of the offer) by transferring it at his choice:

to one of the return or pickup points indicated on the online store website at: https://paevskayahomedesign.ru/delivery/.

- to the seller’s courier at the buyer’s location. An application for a return using this method must be submitted by calling the seller.

If a product is returned of proper quality, the buyer pays for the return via courier at the seller’s rates indicated on the online store website at: https://paevskayahomedesign.ru/delivery/.

7.5. When returning goods (both of good quality and with defects), the seller returns to the buyer the cost of the goods no later than 10 (ten) days from the moment the buyer requests a refund, to the bank details from which the money was received by the seller or which the buyer will notify in writing. If a quality product is returned, the cost of return delivery by courier to the seller of the returned product is deducted from the refund amount.

7.6. The Buyer has the right to exchange goods of good quality, which do not suit him in shape, dimensions, style, color, size or configuration, within 14 (fourteen) days, not counting the day of delivery of the goods, for a similar product from the Seller’s assortment, if such goods are in stock.The exchange is carried out by agreement with the Seller under the conditions established by the legislation of the Russian Federation.

The provisions of this paragraph do not apply to goods made to order or according to the Buyer’s individual parameters, if such goods can be used exclusively by the Buyer purchasing them.

8. Other provisions

8.1. Everything that is not regulated by the offer is determined in accordance with the legislation of the Russian Federation.
